Happy Lemon Rewards Program

Earn Lemons: Earn one lemon for every seven dollars ($7.00) you spend (a) in-store at a participating Happy Lemon location, and (b) on the Happy Lemon App. You will not receive any lemons for gift card purchases or for purchases made via third-party food delivery platforms.
Happy Lemon App: To earn lemons, you must download the Happy Lemon App, register to become a member of the Happy Lemon Rewards Program, and be logged into your member account on the Happy Lemon App when you make a qualifying purchase.

- In-Store Purchases. At the time of an in-store purchase, you must use the Happy Lemon App to present the QR Code associated with your Member Rewards account to the cashier. The cashier has no obligation to remind you, so you must proactively present the QR Code to the cashier at the time of purchase. No lemons will be issued after a qualifying purchase transaction has been completed, so if you fail to present your QR Code at the time of a qualifying purchase, you will not receive any lemons. Lemons cannot be issued retro-actively.
- Purchases on the Happy Lemon App. Lemons will be automatically credited to your member account within forty-eight (48) hours after the transaction is completed. Lemons are calculated based on the actual amount paid for the purchased items; provided that consumption fees and taxes are excluded from such calculation.
- Lemons Redemption: Lemons can only be redeemed (a) in-store at a participating Happy Lemon Boba location and (b) on the Happy Lemon App. For every ten (10) lemons, you will be able to redeem one drink.

General Rules for Member Rewards Program

Lemons expire 10 years from date they are credited to your Member Rewards account.
All lemons have no cash value and cannot be transferred, sold or exchanged. You may not redeem any lemons for cash, except as required by law.
Lemons are not refundable once redeemed.
No lemons will be awarded for gift card purchases.

Additional Terms and Conditions for Member Rewards Program

Please read the following terms and conditions (these “Terms”) for the Yummy-town USA LLC, dba Happy Lemon (“Happy Lemon”) Rewards Program (the “Program”). Happy Lemon reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms at any time. It is your responsibility to check these Terms periodically for changes, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use or participation in the Program following the posting of changes will mean that you accept and agree to the changes.

BY ACCESSING, USING OR PARTICIPATING IN THE PROGRAM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS, HAPPY LEMON’S PRIVACY POLICY, HAPPY LEMON’S TERMS OF USE, AS WELL AS ANY OTHER TERMS AND CONDITIONS APPLICABLE TO THE PROGRAM, WHICH ARE ALL INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THE TERMS IN ANY OF THE ABOVE, YOU MAY NOT PARTICIPATE IN THE PROGRAM.

Program Overview:

The Program is a way of thanking you for your continued support. To enroll in the Program, download the Happy Lemon App (the “App”) and follow the instructions to create an account on the App. You can redeem lemons (a) in-store at a participating Happy Lemon location and (b) on the App. Lemons have no cash value and cannot be transferred to another person.

Registration:

The registration process will require you to provide true, accurate, current and complete information about yourself to us through an online registration form. Personal information collected may include (as applicable): username (email address), password, your rewards card number and card security code (scratch to see), name, mobile phone number, zip code, city and your marketing preferences (e.g., what type of product information you would like to receive from us).

Communication about the Program is made by email, SMS or push notification. At registration, you can opt to receive information on products and special offers. You can change these preferences at any time on the App.

You must be of legal age of majority, or have the consent of a parent or guardian, in order to register and create an account.

Account, Password and Security:

You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify us of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Program via the App. We will not be liable for any loss or damage arising from your failure to comply with this Section.

Termination:

We reserve the right to terminate your account and/or your participation in the Program if we determine, at our sole discretion, that you have violated these Terms, or that the use of your account is unauthorized, fraudulent or otherwise unlawful.

We reserve the right to terminate, discontinue, modify or cancel the Program at any time and at our sole discretion without notice to you.

HAPPY LEMON AND OUR PROGRAM PROVIDER, AND EACH OF THEIR AFFILIATES (COLLECTIVELY, THE “INDEMNIFIED PARTIES”), MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PROGRAM, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT ANY OF THE INDEMNIFIED PARTIES ARE FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD IN YOUR PROGRAM ACCOUNT. THE INDEMNIFIED PARTIES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE OR USE) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE PROGRAM OR THESE TERMS. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
